(c) Take steps to contain the breach and mitigate any potential harm.

13. Use of Images, Video, and Social Media

13.1. Scope: This clause applies to all visual and audio-visual content (including but not limited to photographs, videos, virtual tours, and digital images) captured by us or our representatives at your property (“Property Content”).

13.2 Prior Written Consent & Image Release Agreement Required:

(a) We value your privacy and the sanctity of your home. We will not capture, use, or share any Property Content that identifies your specific address, personal belongings, or any household members for any commercial, marketing, or promotional purpose without first obtaining your separate, express, and written consent.

(b) Such consent must be provided via our standard Image Release Agreement. We will not rely on verbal consent or consent implied through other communications (e.g., email or text message) for this purpose.

(c) The Image Release Agreement will specify, at a minimum:

(i) The specific Property Content to be captured (e.g., “photos of the main living area and kitchen after the clean”);

(ii) The specific channels and purposes for which the Content may be used (e.g., “on the company’s Instagram and Facebook pages for promotional purposes”);

(iii) A clear statement of your consent;

(iv) Confirmation that you have the authority to grant such consent.

13.3. De-identified Content:

(a) We may use de-identified details of the services provided for case studies, training, and internal improvement. “De-identified” means the information does not contain personal information or any details that could reasonably be used to identify you or your specific property location.

(b) For example, we may refer to having “cleaned a 4-bedroom house in the Gold Coast hinterland” without using your name, address, or any distinguishing images.

13.4. Withdrawal of Consent:

(a) You may withdraw your consent for the use of Property Content at any time by providing us with written notice at info@thepcp.com.au.

(b) Upon receipt of your withdrawal, we will make all reasonable efforts to promptly cease using the specified Property Content in future publications and remove it from our owned channels (e.g., our website and social media feeds where we have direct control).

(c) You acknowledge and agree that it may not be technically feasible to remove the Content from every instance, such as from third-party websites, archives, or materials already distributed in print or digitally to the public prior to your withdrawal.

13.5. No Compensation: You agree that you will receive no financial compensation or other remuneration for the use of any Property Content for which you have provided consent.

13.6. Your Representations: By providing consent, you represent and warrant that you are the owner of the property or have the full authority to grant the rights contained in the Image Release Agreement.

14. Destruction or De-identification of Personal Information

14.1. We will take such steps as are reasonable in the circumstances to destroy or de-identify personal information that we hold once it is no longer needed for any purpose for which it may be used or disclosed under the APPs, unless we are required by law or a court/tribunal order to retain the information.

14.2. We maintain a data retention schedule to systematically manage the secure destruction or de-identification of personal information.

15. Government Identifiers

15.1. We will not adopt a government-related identifier of an individual (e.g., a Tax File Number, Medicare Number, or Driver’s Licence number) as our own identifier of the individual unless required or authorised by law.

15.2. We will not use or disclose such an identifier unless the use or disclosure is necessary for us to verify the individual’s identity for the purposes of our activities or functions, or as required or authorised by law.

16. Links to Third-Party Websites

16.1. Our website may contain links to other websites not operated or controlled by us (“Third-Party Sites”).

16.2. This Privacy Policy applies only to our own practices. We are not responsible for the privacy policies, content, or data handling practices of any Third-Party Sites. We encourage you to review the privacy policies of any Third-Party Sites you access.
