WEBSITE TERMS & CONDITIONS OF USE

1. Acceptance of Terms

1.1. By accessing and using https://theprestigecleaningpeople.com.au (“the Site”), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions of Use, our Privacy Policy, and Client Services Agreement.

1.2. If you do not agree with any part of these terms, you must not use our Site.

2. Use of the Site

2.1. You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else’s use and enjoyment of the Site.

2.2. Prohibited behaviour includes harassing or causing distress to any person, transmitting obscene or offensive content, or disrupting the normal flow of dialogue within our Site.

2.3. You must not attempt to gain unauthorized access to any part of the Site, other accounts, or any connected systems or networks.

3. Intellectual Property

3.1. All content on this Site, including but not limited to text, graphics, logos, images, audio clips, digital downloads, data compilations, and software, is the property of The Prestige Cleaning People Pty Ltd or its content suppliers and is protected by Australian and international copyright laws.

3.2. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use any content from our Site for commercial purposes without our express written consent.

3.3. All trademarks, service marks, and trade names displayed on the Site are proprietary to us or other respective owners.

4. User-Generated Content

4.1. If you submit any content to the Site (including testimonials, reviews, or comments), you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sub-licensable right to use, reproduce, modify, adapt, publish, translate, and distribute it throughout the world in any media.

4.2. You represent and warrant that you own or otherwise control all rights to the content you submit and that the content is accurate, does not violate these Terms, and will not cause injury to any person or entity.

4.3. We reserve the right to monitor, edit, or remove any user-generated content at our sole discretion.

5. Online Bookings and E-Commerce

5.1. Any service booked through this Site is subject to our separate Client Services Agreement. The act of booking online constitutes your acceptance of those terms.

5.2. We reserve the right to refuse or cancel any booking or order at our sole discretion, including for suspected fraud, unauthorized activity, or violation of these Terms.

5.3. In the event of cancellation by us, we will notify you and provide a full refund if payment has been processed.

6. Website Availability and Disclaimers

6.1. We use reasonable endeavours to ensure the accuracy and availability of our website but do not guarantee uninterrupted or error-free access.

6.2. We may suspend, withdraw, or restrict access at any time without notice for maintenance, updates, or security reasons.

6.3. The content on our Site is provided for general information only and should not be relied upon without consulting primary sources of information.

7. Limitation of Liability

7.1. To the fullest extent permitted by law, The Prestige Cleaning People Pty Ltd shall not be liable for any direct, indirect, punitive, incidental, special, or consequential damages arising out of, or in any way connected with, your use of or inability to use the Site.

7.2. This includes, but is not limited to, damages for loss of profits, data, or other intangible losses, even if we have been advised of the possibility of such damages.

8. Indemnity

10. Governing Law & Jurisdiction

10.2. You irrevocably submit to the exclusive jurisdiction of the courts of that State or Territory.

We reserve the right to amend these Terms at any time. The updated version will be posted on our Site with the effective date. Your continued use of the Site after any changes constitutes your acceptance of the new Terms.


GDPR PRIVACY NOTICE & RIGHTS (FOR EU DATA SUBJECTS)

1. Lawful Basis for Processing

1.1. For individuals located within the European Union (EU), we process your personal data on the following lawful bases:

(a) Performance of a Contract: To fulfil our obligations under the Client Services Agreement.

(b) Consent: Where you have given clear consent for specific purposes, such as direct marketing.

(c) Legitimate Interests: For purposes such as website security, fraud prevention, and improving our services.

2. Data Subject Rights under GDPR

In accordance with the General Data Protection Regulation (GDPR), you have the following rights:

2.1. Right of Access: You can request a copy of the personal data we hold about you.

2.2. Right to Rectification: You can request correction of inaccurate or incomplete data.

2.3. Right to Erasure (‘Right to be Forgotten’): You can request the deletion of your personal data where there is no compelling reason for its continued processing.

2.4. Right to Restrict Processing: You can request that we suspend the processing of your personal data.

2.5. Right to Data Portability: You can request a structured, machine-readable copy of your data to transfer to another service provider.

2.6. Right to Object: You can object to the processing of your personal data based on our legitimate interests.

3. Data Transfers Outside the EU

3.1. As our business is based in Australia, any personal data you provide will be transferred to and processed in Australia.

3.2. The European Commission has recognised Australia as a country providing an adequate level of data protection. We also implement robust contractual and security measures to ensure your data is protected.


GENERAL TRADING TERMS

1. Services and Scope

1.1. We supply cleaning services as described in quotes, proposals, or booking confirmations.

1.2. Services are limited to inclusions set out in the agreed scope unless otherwise agreed in writing via a formal Variation Form.

1.3. Excluded Services: Our Services expressly exclude:

(a) Biohazard cleaning (e.g., faeces, blood, syringes)

(b) Mold remediation, pest control, or odour elimination

(c) Cleaning exterior windows above ground floor level

(d) Moving heavy furniture (over 20kg) or appliances

2. Pricing and Quotations

2.1. All prices listed on the Site are in Australian Dollars (AUD) and are subject to change without notice.

2.2. Quotes are prepared based on information you provide and remain valid for thirty (30) days.

2.3. We reserve the right to revise prices if property conditions, access, or requirements differ materially from information provided.

3. Payment Terms

3.1. Unless otherwise agreed in writing, payment is due seventy-two (72) hours prior to service commencement.

3.2. We accept:

• EFT/Bank Transfer/Direct Deposit
• Credit Card (via Stripe, Apple Pay, Google Pay)
• Other methods as agreed in writing

3.3. Overdue amounts incur interest at 2% per month, plus reasonable recovery costs including debt collection and legal fees.

4. Cancellations and Access

4.1. Client-Initiated Cancellations:

(a) Cancellations made with more than seventy-two (72) hours notice prior to the scheduled service will receive a full refund of any amounts paid.

(b) Cancellations made within forty-eight (48) to seventy-two (72) hours of the scheduled service will incur a cancellation fee of 50% of the quoted service amount, and any amounts already paid will be retained. The outstanding balance of the cancellation fee becomes immediately due and payable.

(c) Cancellations made within twenty-four (24) to forty-eight (48) hours of the scheduled service will incur a fee equal to the full quoted service amount. If paid in part, the full service fee becomes due and payable immediately.

4.2. Access Failure:

(a) If our team attends the scheduled service but cannot access the property or commence work due to your actions or omissions (including but not limited to: failure to provide keys/access codes, inadequate parking, unsafe conditions not previously disclosed, or the property being occupied in a manner that prevents service delivery), you will be charged the full quoted service fee amount.

(b) Our team will wait a maximum of 15 minutes from the scheduled start time before departing and charging the full fee.

(c) Repeated access failures may result in termination of service agreements.

4.3. Company-Initiated Cancellations & Refusals:

(a) We reserve the right to cancel or refuse service immediately for:

  • Safety concerns (including but not limited to: violent or aggressive behaviour, drug use on premises, biohazard conditions, structural hazards)

  • Hostile, abusive, or threatening behaviour towards our staff

  • Unsanitary conditions that pose health risks to our team

  • Discovery of illegal activities on the premises

  • Failure to secure pets as required by our pet policy

  • Material misrepresentation of service conditions

(b) In such cases, you will be charged the full quoted amount for the scheduled service.

(c) We may terminate ongoing service agreements immediately under these circumstances without liability.

4.4. Weather & Unforeseen Circumstances:

(a) We may cancel or reschedule services due to extreme weather conditions, natural disasters, or other circumstances beyond our reasonable control without penalty.

(b) In such cases, we will reschedule your service at the earliest available opportunity at no additional cost.

4.5. Chronic Cancellations:
Clients who repeatedly cancel services with less than 48 hours notice may be required to pay a non-refundable booking fee for future services or may have their service agreement terminated at our discretion.

5. Client Obligations

5.1. You must provide safe, unobstructed access to the property with running water and electricity.

5.2. You must disclose any health and safety risks, hazards, or site-specific requirements before service commencement.

5.3. You must secure all pets and remove or secure fragile, valuable, or sentimental items.

5.4. You must not solicit, engage, or employ our staff or contractors for twelve (12) months following service completion.

6. Health and Safety

6.1. We comply with Work Health and Safety legislation in Queensland and New South Wales.

6.2. We reserve the right to refuse or cease work immediately if conditions are deemed unsafe or if our staff face aggression or abuse, without liability.

7. Insurance and Liability

7.1. We hold current Public Liability Insurance and Workers’ Compensation/WorkCover.

7.2. To the maximum extent permitted by law:

(a) Our liability is limited to re-supplying services or paying the cost of re-supply

(b) We are not liable for consequential, indirect, or incidental damages

(c) Total aggregate liability is limited to fees paid for the specific service

7.3. These Terms do not exclude your statutory rights under the Australian Consumer Law.

8. Satisfaction Guarantee & Make Right Policy

8.1. If dissatisfied with service quality, you must notify us in writing with photographic evidence within twenty-four (24) hours of service completion.

8.2. We will review and, if justified, perform a remedial clean within seventy-two (72) hours.

8.3. This is your sole remedy for service quality issues.

9. Image and Content Usage

9.1. By engaging our services, you agree that we may capture and use visual content of the property for training and marketing purposes, subject to a separate Image Release Agreement.

9.2. We will not use content that identifies individuals or compromises security without explicit consent.

10. Force Majeure

Neither party shall be liable for failure to perform obligations due to circumstances beyond reasonable control, including acts of God, war, fire, flood, pandemics, strikes, or government actions.

11. Complaints and Feedback
